I am not sure of the rules for this, but I thought Seattle's big issue was if they signed SA long term after franchising him, they lose the right to use the franchise tag on any player for the length of the new contract.
Maybe if he doesn't sign the franchise tender first, there isn't any penalty?

I don't think that's how it works. In that scenario, there would be no incentive to signing a player to a long term deal. That would be a raw deal for both sides involved.

There is a 4 month window, from March to July, in which no negotiations can occur. Perhaps this is where this rule would apply, if you tried to tender an offer during this period. Matter of fact, I'd almost bet on the fact that is the case. That seems like enough of a deterent to keep teams from doing it.
