Behind every lawsuit is a lawyer. Of course in this case, he/she is probably hoping they'll settle. What's sad is that they'll probably get it because paying out $30,000 - $40,000 is a whole lot cheaper than it would be to defend it.
There's an old adage: "If it wasn't for lawyers, we wouldn't need lawyers." This is obviously not possible, but there certainly is a degree of truth to it.
I'm going to side with the mother on this. I was a waiter for 3 years and worked in a bar for another 2. I'll bet either the waiter or the bartender messed up. I hung out in bars and restaurants enough to know a lot(not all!) waitresses and bartenders are drunkards and go in the back to smoke a joint or snort a line. I've seen it so often I guess I might be a bit jaded about it.
Also, I don't think I'll blame her for sueing either. The article doesn't go into detail about the lawsuit, but I'll defend her as long as she doesn't go for millions. Someone has to pay the hospital and doctor bills, and it shouldn't be her. If she goes for millions, thats wrong.

She's suing for $75,000, which could cover medical bills (don't know if she has insurance), legal fees and the like. It sounds like a lot but it's not like she'd be getting rich on it.
