BERLIN (Reuters) - A court in Germany rejected a man's compensation claim against an airline after a cabin crew ordered him off a plane because other passengers were offended by his smell, authorities said Thursday.

An appeals court in the western city of Duesseldorf upheld an earlier ruling that British Airways (BA) had acted within its rights by removing the man from the aircraft after a female passenger sitting next to him complained about his smell.

"The stewardess took him to one side and asked him if he could put on a fresh shirt, but they were all in the hold," a court spokesman said. "So then he was asked to leave the plane -- about two minutes before take off."

BA said other passengers were upset by the smell, he added.

The corporate lawyer and his wife were scheduled to return home from Hawaii via Los Angeles on a BA flight sub-contracted to American Airlines last year, and missed their connection to Germany when the incident forced them to take the next plane.

Including the cost of staying an extra night in Los Angeles, the earnings he had forfeited and his wife's lost holiday time, the man calculated BA owed him nearly 2,200 euros ($2,819), and took his case to a lower court in Duesseldorf earlier this year.

"The man said he couldn't help sweating after carrying three suitcases in 29 degrees (Celsius) of heat and sitting in the airport for two hours with no air conditioning," the court spokesman said.

"But the court said the airline's terms and conditions made clear they could bar passengers because of their smell."

The appeals court delivered a judgement Wednesday by default against the man when he failed to attend the hearing. The man, who told the court he was stuck in traffic, has the right to appeal.

I will say up front that this incident actually took place in several different areas, but since it was British airways, the people involved were from Germany, and the court system was in Germany, I saw no reason it didn't fit in this category. ;-D

The entire incident with the exception of the law suit took place in the United States, and the answer is Germany? :-? Were the passengers that had the customer kicked off German? I doubt it. My guess is they were as American as you or me.

This was a horrible story to use for the "Germany or Florida" game. Of all the thousands of stories to choose from, why pick one that occurred in both the United States AND Germany? Just to trick us? This story should be thrown out completely. If it's not, I'm not going to lose any sleep about it, but I certainly won't bother playing anymore. Who want to play a game that doesn't have any integrity, you know? Just my .02

Here's another version of the same story BTW
http://english.cri.cn/2947/2006/11/16/167@163712.htm

Not saying that this changes anything for sure, but they were living in Germany. See emboldened part of story above^

What does his Nationality have to do with anything? The incident described in the story happened in the United States, not Germany. If this incident actually DID occur in Germany, he probably wouldn't have gotten kicked off the plane in the first place.

Maybe you didn't try to trick everyone, but it's a bad question regardless.

The question was fine. The game is to choose whether the people involved are from Germany or Florida. I see no problem with it. ;-D

LOL, I predicted you would make a post claiming not to have a problem with the question. In consistantly trying to prove me wrong, you just proved me right. :-b

The reasoning behind the game according to Adam Corolla is that "All weird stories emanate from either Germany or Florida"...

Emanate"
1. to flow out, issue, or proceed, as from a source or origin; come forth; originate.
2. to send forth; emit.

... and the object of the game is "to have a listener read off a strange, macabre, or just plain weird news story and have the hosts (and guests) choose Germany or Florida"

Considering the man was kicked off the plane IN HAWAII, how could this story have emanated out of Germany? :-?

Didn't you already post the origin of the game earlier? Why after posting the origin of the game, would you modify the purpose of the game to say "The game is to choose whether the people involved are from Germany or Florida"? You know very well the point of the game is to decide where the story came from, NOT where the people in the story came from.

I guess disagreeing with me is more important than looking at an issue objectively and fairly. That's ok, I've come to expect nothing less. ;-D

Do you really think this is worth getting your panties in a twist over?

If it means that much to you, stop crying about it and go out and find some stories of your own and YOU run the game. Stop armchair quarterbacking someone else's efforts and make the effort on your own.

Yes. What's the point of playing a game if the questions are completely and totally ambigous? What's the big deal of saying... "Sorry, bad question... here's another one"? Why try to convince people the question was good in the first place when it so clearly wasn't?

So what you're basically telling me is that I'm wrong to give my opinion on the answer being "Germany"? This coming from the single most opinionated person in GT? Sorry, but I don't think I'll take your advice... or play this game again.

BTW, I liked how you twisted it around to make it look like my problem was with joelamosobadiah. Took you a minute to think of how to spin it, didn't ya? ;-D

Proving once again it's easier to sit back and criticize than put out something of your own in the first place. What a shocking, shocking reply. ;-7

Is that really the best reply you can come up with to retort the ealier points I made? Geez, it was hardly worth my effort. At least when I'm wrong about something I'm humble enough to admit it. I also don't allow my dislike for another member to change my stance on something out of spite.

I'm taking a break from this place.

But not in this case, of course. ;-7
