They're not getting a pass. If Team 4 hadn't beaten Teams 2 and 3, he wouldn't have had the same record as them and would have been out of contention.

If Team 4 beat Team 2 and 3 and they have the same record then Team 4 deserves the spot - he BEAT the other two teams already.

Well, deserve is a different question than the one that is being asked, but you could very well say that Teams 2 and 3, although Team 4 scored more than them on particular weeks, deserve the spot more since they scored more points over the course of the season. Team 4 got lucky enough to have the record that he has, given his points. No reason to augment that luck by giving him the tiebreaker as well.

But his question wasn't about deserving. It was how to handle it. And I would move on down the tiebreakers, although I could see the logic of treating each wildcard seat individually.
