Well, they would assumedly sue for recission and then as a follow-on unauthorized use of likeness. And since they can't get injunctive relief, sue for monetary damages.

In law school, I talked about the idea of going to a bar, running up a tab, and then refusing to pay on diminished capacity grounds, that I hadn't formed a binding contract to purchase the alcohol. My professor was bemused but thought I was better off simply paying, pointing out that in Lucy v. Zehmer the guy was, "high as a Georgia pine" but the contract was still upheld.

I like how they both of them claimed they lost out on a job or internship because of what they said in the movie. Honestly, I saw the movie and I wouldn't be able to recognize them if they were standing in front of me, talking about Borat. Only way the movie cost them their job opportunities is if they wrote on their resumes, "I was one of the drunken idiot frat boys on the movie Borat."

Which brings up (to my mind) something that occurred to me last night.

What if this is a ploy? What if these guys are part of the movie-promotion machine? It's possible. Think about it - the lawsuit came out just before the movie was released (or was it just after?), and now it's reached its first stage at this point where the movie is slipping and could use a boost.

At the very least it's free advertising. At best it's a pretty clever way to make an already edgy movie seem edgier.

It's far-fetched but possible.

If your suggestion has any shred of truth to it knapplc, then I guess I wouldn't be too surprised, considering the media blitz the actor had been on promoting Borat.

In fact, when my December issue of Maxim magazine came in the mail in mid November, imagine my dispair when I noticed it wasn't some hottie in her underwear but this instead

I honestly wouldn't be surprised. You know that some of those scenes had to be known by the people who did them, Like Pam was in out it.

I mean look at the amount of press that is coming out, and the DVD is about to come out
