Stallworth had been using marijuana, but not necessarily prior to his driving and killing the pedestrian. Police, lawyers, and family all knew this prior to the settlement, but Stallworth's indefinite suspension will likely continue, um...indefinitely.

Cleveland Browns wide receiver Donté Stallworth reportedly tested positive for marijuana after he fatally struck a pedestrian with his car while driving drunk March 14.
Stallworth is serving a 30-day jail sentence after pleading guilty to DUI manslaughter in the death of Mario Reyes, 59. He also reached an undisclosed financial settlement with Reyes' family.
Stallworth has been suspended indefinitely by the NFL. Attorney David Cornwell, who is representing Stallworth in that matter, released a statement yesterday after the Miami Herald reported on its Web site, citing unidentified sources, that the receiver tested positive for marijuana after the accident.
